a) Market analysis and consultation include assessing risks and opportunities related to the market for the bidder selection method under consideration, the ability of bidders to participate, market conditions for goods and services available for the project, and market trends during project implementation. Based on the scope and nature of the package, market analysis and consultation should include information on the availability of goods and services for the package in the market, potential costs that may arise if innovative solutions are required, warranty terms, types of contracts commonly applied to similar procurement packages by other investors, legal regulations (if any) for goods and services under the package, the feasibility of applying sustainable procurement, purchasing environmentally friendly services, information on goods and services utilizing recycled materials, energy-saving products, and the potential participation of small and micro-enterprises, startups, enterprises employing a large number of women, veterans, disabled people, or ethnic minorities; supply chain analysis (availability of materials, supplies, goods, and services for contract execution); the possibility of organizing bidder selection limited to goods of Vietnamese origin according to Article 10, Clause 3(e) and Article 56, Clause 1 of the Bidding Law and other necessary information;
b) Market consultation can be carried out through one or more of the following methods: reviewing the most recent market consultation results for similar goods and services; posting market consultation questions on appropriate communication channels; researching catalogs and product materials from manufacturers, suppliers, distributors, agents; consulting the experience of other investors who have conducted market consultations, consulting bidder selection results for similar procurement packages of goods and services; organizing market consultation conferences with potential bidders on a transparent basis; organizing surveys from business units; consulting experts in related fields, print media, magazines, specialized market analysis publications, Internet information, and other appropriate forms;
c) The investor may hire consultants to conduct market research, use independent experts or agencies, or businesses in the market for preparing the overall bidder selection plan, bidder selection plan, bidding documents, and request for proposals, ensuring competition, fairness, and transparency.]
- Risk identification and management in bidding

a) Analyzing key risks related to the operating environment, market conditions, the capacity of the organization conducting the bidder selection, and the complexity of bidding activities;

a) State budget estimates approved by competent authorities according to the budget period or projected budget estimates for the next year or multi-year procurement; projected legal financial resources within the fiscal year or projected legal financial resources for subsequent years or multi-year procurement;
b) The value of the procurement work performed during the fiscal year, budget year;
- Funds not used for procurement;
d) Procurement estimate, determined by funds defined in item a of this clause, minus the funds defined in item b and item c of this clause. The investor is not required to appraise or approve the procurement estimate.
In cases where the investor has available funds for procurement in the budget year, fiscal year, and does not use projected revenues for the year, the procurement estimate does not need to be determined as stipulated in this clause. In this case, the procurement estimate is the available funds for procurement in the budget year, fiscal year. In cases where the contract duration exceeds one year, or the contract's effective date and completion date do not fall within the same fiscal year, clearly state the procurement estimate for the budget year, fiscal year, and the projected procurement estimate for subsequent years.
This section also clearly states the name of the investor; the budget year, fiscal year of the procurement estimate.
In cases where an investment project is formed for the procurement estimate and bidder selection is organized for the investment project, the summary of the project in Section I (Summary description of the project, procurement estimate) only needs to provide an overview of the project as guided in Section I.1 without the need to provide an overview of the procurement estimate as guided in Section I.2. In this case, it is necessary to clearly state that the investment project is part of the procurement estimate (not an investment project under the Law on Public Investment, a project of state-owned enterprises, or enterprises wholly owned by the state). The procedures for submission, appraisal, and approval of the content in the bidding process follow the regulations as for investment projects (the bidder selection method follows the guidance in note (6) of Section V.1).

(1) The work that does not apply any bidder selection methods includes: activities of the project management board, land clearance compensation organization, interest payment; works carried out by the investor itself, including the preparation, appraisal of expressions of interest, prequalification documents, bidding documents, and request for proposals; evaluating expressions of interest, prequalification applications, bid documents, and proposals; appraising prequalification results, expressions of interest, bidder selection results; other tasks that cannot apply bidder selection methods with corresponding values. This part also includes procurement packages valued at no more than 50 million VND, to be procured following the process stipulated in Clause 4, Article 23 of the Law on Bidding. Note:
(1) The tasks included in the bidder selection plan must clearly state the number of packages and the content of each package. The unit submitting the bidder selection plan clearly explains the basis for dividing the project, procurement estimates into packages in Section V.2 of this report.
(2) Fill in the name of the investor or the unit assigned to prepare the project in case the investor is not yet identified for pre-bid packages as per Article 42 of the Law on Bidding or packages that need to be implemented before project approval.
(3) Enter the package name in the "Package Name" column; summarize the main scope of the package's work in the "Summary of main tasks of the package" column.
The content and scope of the package work should align with the content stated in the project approval decision and the procurement estimate. In cases where the package is divided into several separate parts, the name of each part must reflect the basic content of each section.
(4) The package value is determined according to the provisions of Clause 2, Article 39 of the Law on Bidding.
(5) The funding source is implemented in accordance with Points c and d of Clause 1, Article 38, Clause 3, Article 39 of the Law on Bidding.
(6) The bidder selection method is implemented in accordance with Clause 4, Article 39 of the Law on Bidding; the application of each bidder selection method is implemented according to Section 1, Chapter II, and Clause 6, Article 43 of the Law on Bidding, Section 2, Section 3, Chapter VII of Decree No. 24/2024/ND-CP.
For bidder appointment packages specified at Point m, Clause 1, Article 23 of the Law on Bidding, if proposing to apply the simplified process, note “simplified bidder appointment” in this section; if proposing to apply the regular process, note “regular bidder appointment” in this section.
In case of forming an investment project for the procurement estimate according to Section I (Summary description of the project, procurement estimate) and the package is within the bidder appointment limit (from over 50 million to 100 million VND), note “simplified bidder appointment” if proposing to apply the simplified process; note “regular bidder appointment” if proposing to apply the regular process.
For online price offerings, specify either regular or simplified online price offerings according to Clauses 2, 3, Article 98 of Decree No. 24/2024/ND-CP. For individual consultant selection, specify either regular or simplified individual consultant selection according to Clause 2, Article 71 of Decree No. 24/2024/ND-CP.
(7) The bidder selection approach is implemented according to Section 2, Chapter II of the Law on Bidding. The one-stage two-envelope method is only applied for open bidding, limited bidding for non-consulting services, goods procurement, construction, mixed packages requiring advanced technology according to the law on science and technology based on the provisions in Clause 1, Article 31 of the Law on Bidding; open bidding, limited bidding for consulting service packages.
For packages applying simplified bidder appointment, this content is not noted.
(8) Note the total time for organizing bidder selection (the maximum number of days calculated from the date of issuance of bidding documents, request documents to the date of bidder selection result, including appraisal time. If necessary, the time for evaluating bid documents, proposals, and appraisal time can be noted in this section.
In case the package has a shortlist selection, the time for organizing bidder selection includes the time for shortlist selection calculated from the date of issuance of prequalification documents, expressions of interest documents until the shortlist selection result (the time for evaluating prequalification documents, expressions of interest documents, and appraisal time can be noted).
For handling situations according to Clause 4, Article 131 of Decree No. 24/2024/ND-CP and for cancellation of bidding as per Clause 1, Article 17 of the Law on Bidding, there is no need to adjust the start time for organizing bidder selection in the bidder selection plan.
(9) The start time for organizing bidder selection is implemented according to Clause 5, Article 39 of the Law on Bidding.
(10) The contract type is implemented according to Article 64 of the Law on Bidding.
(11) The contract execution time is implemented according to Clause 7, Article 39 of the Law on Bidding.
The contract execution time should be appropriate to the project implementation schedule and procurement estimate. In cases where the package consists of multiple separate parts, the specific execution time for each part should be clearly stated.
For centralized procurement applying framework agreements, the package execution time is based on the framework agreement.
(12) The additional purchase option only applies to open bidding, price negotiation packages, and is implemented according to Clause 8, Article 39 of the Law on Bidding. If applying the additional purchase option, clearly state the quantity or volume that can be added as a percentage of the corresponding contract volume, ensuring it does not exceed 30%, and provide the estimated corresponding value. If not applying the additional purchase option, note “not applicable”.
(13) For packages proposed to apply monitoring, specify the individual or unit proposed to monitor bidding activities along with email, phone number, and contact address. For packages where monitoring of bidding activities is not proposed, leave this section blank.
For packages under 500 million VND, the investor proposes to the competent authority to apply or not apply the requirement that only bidders with 50% or more of their labor force being disabled, war veterans, or ethnic minorities with labor contracts for a period of 03 months or more and valid at the time of bidding closure according to Clause 1, Article 7 of Decree No. 24/2024/ND-CP. In cases where the competent authority decides to apply, but no bidders participate or no bidders meet the requirements, the bidding process is re-organized, and the bidder is no longer required to meet this requirement. The application of bidder selection methods in this case is based on Note (6).
2. Explanation of bidder selection plan content:
In this section, it is necessary to explain the contents of Table 3, specifically as follows:
a) Basis for dividing the packages:___[explain the basis for dividing the project and procurement estimate into packages. The division of the project and procurement estimate into packages must be based on the content of the project, procurement estimate, the nature of the work, the execution sequence over time, and according to the following principles:

This section clearly states any reservations held by the appraisal members during the process of appraising the bidder selection plan.
Based on the scope and nature of the package, the appraisal unit may provide comments on whether the authority should appoint an individual or unit to supervise bidding activities.
2. Recommendations
a) In the case that the bidder selection plan content complies with the law on bidding, related laws, and meets the requirements, the appraisal unit proposes that the authority approve the bidder selection plan as follows:
