1. Amending and Supplementing Bidding Document Templates (Except for Medicines)

According to Clauses 2 and 3, Article 31 of  Circular 06/2024/TT-BKHDT , the regulations are as follows:

2. From the effective date of this Circular, Circular 01/2024/TT-BKHDT ceases to be effective, except for the content stipulated in Clause 3 of this Article.

3. Templates No. 7A and 7B issued with Circular 01/2024/TT-BKHDT remain effective until the Circular guiding the bidding for medicines at public healthcare facilities issued by the Ministry of Health takes effect.

2. Adding Regulations for Individual bidders

According to Section 2 on Individual bidders in Chapter IV (from Articles 71 to 75) of Decree 24/2024/ND-CP, additional regulations are stipulated for packages dedicated to individual consultants. Therefore, Circular 06/2024/TT-BKHDT (point c, clause 8, Article 3) adds the following role:

8. Organizations participating in the System are agencies, organizations, and individuals registering to participate in the System with one or more of the following roles:

 

a) Investor;

b) Inviting Party;

c) bidder (individual, group of individuals participating in the individual consulting package; individual, group of individuals participating in innovative start-up packages for goods procurement; organization; business household);

3. Adding Appendix 3B - Template Decision for Approving bidder Selection Results

Compared to Circular 01/2024/TT-BKHDT, Circular 06/2024/TT-BKHDT adds Appendix 3B - Template Decision for Approving bidder Selection Results.

4. Clarifying Information Posted on the National Bidding Network System

According to Article 19 of Circular 01/2024/TT-BKHDT, the regulations for posting information on the National Bidding Network System are as follows:

Article 19. Information Posting Process on the System

The process for posting information as stipulated in Articles 10, 11, 12, 13, 14, 15, 16, and 18 of this Circular is implemented according to the User Guide.

1. In addition to the information posted on the System as stipulated in Articles 10, 11, 12, 13, 14, 15, 16, 17, and 19 of this Circular, other information that must be posted and implemented on the System includes:

 

a) The minutes of bid opening for offline bidding must be posted on the System within 24 hours from the bid opening time;
b) The decision to cancel the bid must be posted on the System within 5 working days from the date of signing the decision;
c) The documents resolving investor appeals and decisions of the authority must be posted on the System within 5 working days from the date of issuing the appeal resolution documents;
d) The list of technically qualified bidders for offline bidding must be posted on the System within 5 working days from the approval date;
đ) For two-stage bidding, the list of bidders meeting the requirements of the first stage bidding documents and the list of bidders meeting the technical requirements of the second stage must be posted on the System no later than 5 working days from the approval date;
e) The list of foreign bidders winning bids in Vietnam must be posted on the System within 15 days from the effective date of the contract with the foreign bidder.

5. Adding Regulations on Evaluating E-Bid Dossiers for Centralized Procurement Packages

According to point a, clause 1, Article 28 of Circular 06/2024/TT-BKHDT, the regulations on evaluating E-Bid Dossiers (E-HSDT) for centralized procurement packages are as follows:

Article 28. Evaluating E-HSDT

1. The process for evaluating E-HSDT:

 

a) Process 01 applies to all packages, including: evaluating the eligibility of E-HSDT; evaluating capacity and experience; evaluating technical aspects; and evaluating financial aspects.

For centralized procurement packages requiring bidder selection based on supply capacity, the evaluation of bid security, annual average revenue, similar contracts, and production capacity is conducted during the financial evaluation stage.
