The Government's online bidding roadmap is a mandatory requirement, aiming to enhance competition, fairness and transparency. Continuing Circular No. 11/2019/TT-BKHDT detailing the provision and posting of information on bidding, roadmap for applying online contractor selection in 2022, the Ministry of Planning and Investment continues to promulgate Circular No. 08/2022/TT-BKHDT according to which the online bidding route is increasingly shortened and must be applied.
In order for bid solicitors and contractors to understand the mandatory regulations in 2023 and beyond and apply them, we would like to review some notes as follows:
The Government's online bidding roadmap is a mandatory requirement, aiming to enhance competition, fairness and transparency. Continuing Circular No. 11/2019/TT-BKHDT detailing the provision and posting of information on bidding, roadmap for applying online contractor selection in 2022, the Ministry of Planning and Investment continues to promulgate Circular No. 08/2022/TT-BKHDT according to which the online bidding route is increasingly shortened and must be applied.
In order for bid solicitors and contractors to understand the mandatory regulations in 2023 and beyond and apply them, we would like to review some notes as follows:
2. Year 2023:
a) Organize online contractor selection for all (100%) bidding packages applying open bidding, limited bidding, competitive bidding in the fields of goods (including drugs), construction installation, non-consulting services, consulting services with a bidding package price not exceeding VND 200 billion, except for mixed bidding packages, bidding packages applying the two-stage, one-envelope method, two-phase, two-envelope method;
b) The organization of online contractor selection during the year must ensure that the total number of bidding packages reaches at least 90% of the number of bidding packages and at least 80% of the total value of bidding packages using the form of open bidding. limited bidding, competitive bidding, except for mixed bidding packages, bidding packages applying the two-stage, one-envelope method, two-phase, two-envelope method;
c) Organize online contractor selection for all (100%) bidding packages applying open bidding, competitive bidding using state capital for procurement to maintain regular operations of the agency. State agencies, political organizations, socio-political organizations, socio-political-professional organizations, socio-professional organizations, social organizations, units of the people's armed forces, public service units, except for mixed bidding packages, bidding packages that apply the two-phase, one-envelope method, two-phase, two-envelope method.
3. From 2024 onwards:
a) Organize online contractor selection for all (100%) bidding packages applying open bidding, limited bidding, competitive bidding in the fields of goods (including drugs), construction installation, non-consulting services, consulting services with a bidding package price not exceeding VND 500 billion, except for mixed bidding packages, bidding packages applying the two-stage, one-envelope method, two-phase, two-envelope method;
b) The organization of online contractor selection during the year must ensure that the total number of bidding packages reaches at least 95% of the number of bidding packages and at least 90% of the total value of bidding packages using the form of open bidding. limited bidding, competitive bidding, except for mixed bidding packages, bidding packages applying the two-stage, one-envelope method, two-phase, two-envelope method;
c) Organize online contractor selection for all (100%) bidding packages applying open bidding, competitive bidding using state capital for procurement to maintain regular operations of the agency. State agencies, political organizations, socio-political organizations, socio-political-professional organizations, socio-professional organizations, social organizations, units of the people's armed forces, public service units, except for mixed bidding packages, bidding packages that apply the two-phase, one-envelope method, two-phase, two-envelope method.
Thus, in 2023, bidding packages worth less than VND 200 billion will be required to bid online (except for mixed bidding packages, bidding packages applying the two-phase, one-envelope method, two-phase, two-envelope method).
Online bidding document forms apply from 2022
Circular No. 08/2022/TT-BKHDT issued with 06 types of documents corresponding to each field, specifically:
1. For construction and installation bidding packages
a) Form No. 1A is used to prepare the E-HSMT applying the form of open bidding, limited bidding, and competitive offering according to the one-stage, one-envelope method;
b) Form No. 1B is used to prepare the E-HSMT applying the form of open bidding, limited bidding according to the one-stage, two-envelope method;
c) Form No. 1C is used to prepare E-HSMST.

2. For goods procurement packages (including cases of centralized procurement)

b) Form No. 2B is used to prepare the E-HSMT applying the form of open bidding, limited bidding according to the one-stage, two-envelope method;
c) Form No. 2C is used to prepare E-HSMST.

3. For non-consulting service bidding packages

b) Form No. 3B is used to prepare the E-HSMT applying the form of open bidding, limited bidding according to the one-stage, two-envelope method;
c) Form No. 3C is used to prepare E-HSMST.

b) Form No. 7B is used to prepare the E-HSMT using open bidding according to the one-stage, two-envelope method.
