According to Clause 4, Article 2 of Decree 24/2024/ND-CP, online procurement is understood as follows:
4. Online procurement is the direct purchase of goods and services on the national bidding network system from Bidders who have won the bid to provide those goods and services through centralized procurement.
According to the regulations in Article 102 of Decree 24/2024/ND-CP, the application of online procurement must ensure the following conditions:
Article 102. Online Procurement Form1. Online procurement must be approved in the Bidder selection plan and is applied to goods and services of the package with an estimated procurement cost not exceeding 100 million VND; packages for purchasing goods and services under state-owned enterprise investment projects, enterprises with 100% state-owned capital, and investment projects under the Public Investment Law with an estimated procurement cost not exceeding 1 billion VND.2. The duration for applying online procurement for items in the centralized procurement list is the contract implementation period in the case of not signing a framework agreement but not exceeding 12 months from the effective date of the contract or the effective period of the framework agreement.
Also, in Decree 24/2024/ND-CP (Article 103), the online procurement process is regulated as follows:
The national bidding network system automatically extracts information on bidder selection results for centralized procurement into the list of goods and services applied for online procurement.
Based on the list of goods and services extracted in Step 1, the investor, the inviting party in need of online procurement, places orders directly on the national bidding network system.
The order content for each good or service includes:
For each order request, the national bidding network system automatically notifies the previously awarded Bidder in centralized procurement. The Bidder is responsible for confirming or declining the order on the national bidding network system within 03 days from the date of receiving the order request.
The national bidding network system displays the notification about the bidder's order confirmation or rejection and sends the notification to the ordering unit.
Complete, sign, and manage contract implementation (in accordance with the provisions of Articles 32 and 33 of Decree 24/2024/ND-CP). The Bidder manages confirmed orders and is responsible for supplying goods and services as required, ensuring quality and progress.
