When Decree 63/2014/ND-CP was issued, there were very new and important regulations in Clause 3, Article 6 "Preferential for domestic bidding" as follows:
3. For construction and installation bidding packages with a bidding price of not more than 05 billion VND, only contractors that are small and micro enterprises according to the provisions of law on enterprises are allowed to participate in bidding.
This is a new concept to create conditions for small- and micro-scale contractors to participate in construction and installation bidding packages (small-scale bidding packages) to be able to mature, large contractors will not be able to participate in these projects. This bidding package avoids the story of "If you can't do it all, you can't get it done" in construction businesses.
So, where are small and micro enterprises regulated? Let's explore this issue with us.
Small and micro enterprises may change from time to time according to the development of the country's economy. At the time of writing in November 2020, the regulations in Article 6 of Decree 39/2018 are being applied. /ND-CP dated March 11, 2018, then clauses 1 and 2 clearly stated:
1. Micro enterprises in the fields of agriculture, forestry, fisheries, industry and construction have an average annual number of employees participating in social insurance of no more than 10 people and a total revenue of the year of no more than 3 billion VND or total capital not exceeding 3 billion VND.
Micro-enterprises in the field of commerce and services have an average annual number of employees participating in social insurance of no more than 10 people and a total revenue of the year of no more than 10 billion VND or total capital of no more than 3 billion VND.
2. Small businesses in the fields of agriculture, forestry, fisheries, industry and construction have an average annual number of employees participating in social insurance of no more than 100 people and a total annual revenue of no more than 50 people. billion VND or total capital not exceeding 20 billion VND, but not a micro enterprise as prescribed in Clause 1 of this Article.
Small enterprises in the field of commerce and services have an average annual number of employees participating in social insurance of not more than 50 people and a total revenue of the year not exceeding 100 billion VND or total capital not exceeding 50 billion VND, but is not a micro enterprise as prescribed in Clause 1 of this Article.
